Bard Seeking Reimbursement after Dismissal of Vaginal Mesh Lawsuit
Like adding insult to injury, a plaintiff who had filed a vaginal mesh claim against a mesh manufacturer is now being asked by the defendant for reimbursement after the complainant asked for a dismissal of her lawsuit.
Linda Rizzo, who lodged a complaint on December 29, 2009 against C.R. Bard for the injuries she sustained after being implanted with the Avaulta vaginal mesh, was compelled to ask for a dismissal due to a problem with one of her witnesses.
It would seem that her expert witness was not board-certified as a urogynecologist. This sub-specialty is actually a new one, having been established only in 202. Examinations for board certification only started June this year. Regrettably, the doctor who was supposed to testify as an expert witness did not pass the board examination.
This can be very disappointing to the plaintiff. She has lost her opportunity at the moment to seek justice just because of this unfortunate development.
Adding to her woes, lawyers of C.R. Bard are asking the court for reimbursement of expense incurred in the preparation of the case filed by Linda Rizzo. Lawyers of C.R. Bard are requesting payment for attorneys’ fees and related legal costs.
